Selling Off-Plan in Dubai: Assignment Rules, Fees, Timing, 30 Oct 2026

Selling Off-Plan in Dubai: Assignment Rules, Fees, Timing, 30 Oct 2026

Reselling an off-plan property in Dubai before handover is called an assignment. It normally needs the developer's written approval (a No Objection Certificate, or NOC), a minimum amount already paid to the developer, and a transfer registered with the Dubai Land Department (DLD). On 30 October 2026, DLD data showed 472 deals worth AED 981 million, and 41% of them were off-plan.

These figures come from Dubai Land Department (DLD) data. They cover all deals, not only assignments, so read them as background.

With roughly four in ten deals off-plan, many buyers meet the question of what happens if they need to sell before completion. You can browse current Dubai off-plan projects to see what is on the market.

How an off-plan assignment works

The seller transfers their rights under the sale and purchase agreement (SPA) to a new buyer. The buyer takes over the remaining payment plan. The seller is usually paid what they have already paid the developer, plus or minus any agreed difference.

  • Check the contract. The SPA and the developer's policy set out whether, and when, resale is allowed.
  • Confirm the amount paid. Developers commonly require a minimum percentage of the price to be paid first. The percentage differs by developer and project, so ask the developer directly.
  • Request a statement of account. It should show no overdue instalments.
  • Sign the sale agreement. Deals through a RERA-registered broker normally use the standard Form F.
  • Obtain the developer NOC. The developer reviews the request and issues it, usually for an administrative fee.
  • Register the transfer. This is done through the DLD's system and the developer's process, and the new buyer becomes the registered owner of the unit.

Fees to expect

Exact amounts depend on the developer and the deal. Check every item in writing before you commit.

  • DLD transfer fee: typically 4% of the property price, normally paid by the buyer unless the parties agree otherwise.
  • Developer NOC or administrative fee: set by the developer and paid by the seller or buyer as agreed. The amount varies.
  • Agent commission: commonly 2% plus VAT, and negotiable.
  • Registration and admin charges: smaller DLD and trustee-style fees may apply. Confirm the current amounts with the DLD or Dani.

Timing

There is no single fixed timeline. The process depends on how quickly the developer issues the NOC, whether the seller's account is clear, and how fast both sides arrange funds. Some developers also restrict resales close to handover. Ask for the developer's expected processing time at the start.

Checks before a buyer commits

  • Confirm the unit is registered with the DLD and the project has an escrow account.
  • Ask for the original SPA, payment receipts and the developer's statement.
  • Work out the cash needed now: the seller's equity, the 4% fee and other costs, plus later instalments.
  • If you plan to use a mortgage, ask the bank first, because lenders' rules on unfinished property differ.
  • If a Golden Visa matters to you, check the Golden Visa property rules, as off-plan eligibility has conditions.
